filed suit this morning against the city of St. Louis and the city's Comptroller, Rita Houghasian, seeking to force the city to allow payroll deductions from city employees to benefit the group. The suit was filed in U.S. District Court. The suit says the city comptroller has refused the group's request to participate in a charitable payroll deduction program in violation of the First and 14th amendments to the C.S.

Constitution. The United Black Community Fund is a non-profit, tax-exempt, charitable organization supported by voluntary contributions that are used to subsidize a group of about 20 health and welfare service organizations serving primarily the black community. The suit asks that the city's refusal to allow payroll deductions for the United Black Community Fund be declared unconstitutional and that the city be required to 'give the United Black Community Fund the same treatment given the United Way. Alderman Clifford Wilson D-4th Ward, is president of the 7-yeat-oId fund, an affiliate of the National Black United Fund. Wilson said Sunday that the United Black Community Fund has as much right to be included in the city's payroll-deducation program as the United Way, which provides funds to more than 100 charities in the area.

He had been recuperating at his home on Captiva Island. Mr. Croft was a senior partner of the Coburn, Croft Putzell law firm of St. Louis. He was formerly chairman of the boards of Community School and of the Farmington Orphanage, Farmington, Mo.

He also had headed the state Board of Bar Examiners. He is survived by his wife, Anita Brown Croft of Ladue; three sons, Terrence L. of Atlanta, the Rev. Timothy L. of Miami Shores, and Thomas A.

of Durham, N.C.; a daughter, Mrs. Ann Croft Harrison of Ladue; a brother, Dr. Albert J. Croft of Steven's Point, and 12 grandchildren. Ml HYSORE.

Louis trial lawyer for more than 65 years, will be at 2 p.m. Wednesday at Webster Groves Presbyterian Church, 45 West Lockwood Avenue. Mr. Marsalek, 93, a resident of Webster Groves since 1929, died Sunday at St. John's Mercy Medical Center, 615 South New Ballas Road, Creve Coeur.

His wife of 69 years, the former Edith Woodruff, died Dec. 11 at age 91. Mr. Marsalek retired from active legal practice in 1975, but he remained counsel to Moser, Marsalek, Carpenter, Geary, Jaeckel, Keaney Brown. He founded the firm in 1930.

Mr. Marsalek, a native of St. Louis, was admitted to the Missouri Bar in 1910, a year before he graduated from the Washington University Law School. He taught appellate procedure there for many years and received a distinguished alumni citation from the university in 1955. Surviving are a daughter, Edith Curtis, of St.

Louis; a sister, Mary Hardin, of Farmington, and five granddaughters. Services Tomorrow For John C. Vogel Funeral services for John C. Vogel, Harvard Law School in 1921. He was one of the founders of the Lawyers Association of St.

Louis. During World War Mr. Vogel served as a lieutenant with the 354th Infantry, 89th Division. He later was active in the American Legion and other veterans organizations. Mr.

Vogel also served on the civil service commission of the Metropolitan Sewer District. Surviving are his wife, Katy a daughter, Alice V. Stroh, of St. Lonis; and two granddaughters. a lawyer here for nearly 60 years, will be at 11 a.m.

tomorrow at the Kriegshauser South Funeral Home, 4228 South Kingshighway. Entombment will be at Hillcrest Mausoleum. Mr. Vogel, of St. Louis, died Sunday at St.

Louis University Hospitals, 1325 South Grand Boulevard. He was 85. Mr. Vogel had practiced law since 1973 with the firm of Thompson Mitchell. Prior to that, he was a partner for many years in the firm of Foster Vogel.

He graduated cum laude from Sam Levene Actor found dead Sam Levene Dies; Character Actor 50 Years NEW YORK (UPI) Sam Levene, who in 50 years as an actor developed classic comic characters including Nathan Detroit in "Guys and Dolls," was found dead in his apartment here Sunday. He was 75. Mr. Levene, who was best known for his portrayal of Damon Runyon characters, had returned to his home at the St. Moritz Hotel last week after finishing an engagement In Toronto.

His body was found by his son, Joseph. It was not known when the actor died or the cause of his death. Mr. Levene developed the character of Nathan Detroit, the craps game promoter, in the original production of "Guys and Dolls." He was such a natural Nathan that some of the songs in the hit musical were written with the actor's less-than-classic singing voice in mind. The actor appeared in more than 100 plays and movies, most recently "Horowitz and Mrs.

Washington," which had a short run on Broadway last spring and was revived in Canada this month. Thelma Reed Dies Funeral services for Thelma Reed, who was secretary of the Faith Presbyterian Church in Des Peres for the last 15 years, will be at 11 a.m. tomorrow at the Pfitzinger Mortuary, 331 South Klrkwood Road. Burial will be in Valhalla Cemetery. Mrs.

Reed, who lived in Rock Hill, died of cancer Sunday at St. Louis University Hospitals, 1325 South Grand Boulevard. She was 70. Mrs. Reed also served as secretary to the Klrkwood United Church of Christ, 1603 Dougherty Ferry Road.

The two churches had a shared ministry. Surviving are her son, Edward A. Reed, an Oklahoma City lawyer, and her brother; Donald Luddeke, of Belleville, Sister Mary Tracy Mass Tomorrow the high school and college level. In St. Louis, she taught at the old St.

Ann's School in north St. Louis, the old Notre Dame in Wellston, St. Louis Cathedral School, Rosati Kain High School and Fo College. She also taught at schools in Michigan, Illinois, Colorado, Georgia and Wisconsin. She had been living at the Nazareth Convent since retiring in 1967.

Surviving are two sisters, Catherine Tracy and Marguerite Corcoran, both of St. Louis. A Mass of the Resurrection for Sister 'Mary Gertrude Tracy, a St. Louis educator for many years, will be celebrated at 9:30 a.m. tomorrow at the Nazareth Convent Chapel, 2 Nazareth Lane, Lemay.

Burial will be in Nazareth Cemetery. Sister Mary Gertrude died Saturday at the convent. She was 88. She had served in the order of the Sisters of St. Joseph of Carondelet for 71 years.

She had been a teacher for 44 years, teaching in elementary schools and specializing in foreign languages at Sister Aubrey Mass Tonight elementary classes at the old Funeral Mass for Sister Aubrey Reilly, a retired schoolteacher, will be at 7 tonight in the chapel at the Sisters of Loretto Lafayette Retirement Center, 3407 Lafayette Avenue. Burial will be tomorrow in Calvary Cemetery. Aubrey also served in church Illinois, Colorado, California Mexico. She was born in Texas, and was a member of for 65 years. There are no home since 1974, died there Saturday of cancer. She was 86. "'Her teaching career spanned 52 years, 21 of them it Missouri.
